1. Scope of Services
Dave’s Roadside 24/7 provides mobile, light-duty roadside assistance, including battery jumpstarts, lockout assistance, flat tire changes (using the customer’s functional spare tire), tire replacements, battery replacements, emergency fuel/fluid delivery, air delivery, and winch-outs. We do not provide vehicle towing, mechanical repairs, or impound services.
2. Implied Consent & Agreement
By requesting service via phone, text, or our website, you ("the Customer") explicitly agree to these Terms of Service. No physical signature is required to form a binding contract.
3. Customer Obligations & Safety
- Presence: The customer or an authorized adult representative must remain with the vehicle until the technician arrives.
- Safety: The vehicle must be located in a safe area where the technician can legally and safely work (e.g., a parking lot or a safe highway shoulder).
- Ownership: You warrant that you are the lawful owner of the vehicle or have explicit authorization from the owner to request entry (for lockouts) or service.
4. Limitation of Liability (Damage & Delay)
- Pre-existing Conditions: Dave’s Roadside 24/7 is not liable for pre-existing vehicle damage, mechanical failures, or electrical issues (e.g., a battery failing to hold a charge after a successful jumpstart, or a stripped lug nut during a tire change).
- Lockout Risks: Lockout services carry inherent risks to window seals, linkages, and paint. By approving service, you waive liability for minor cosmetic or structural wear resulting from standard entry tools.
- Delays: Arrival times provided during dispatch are estimates only. We are not liable for direct or indirect losses caused by delays due to traffic, severe weather, or safety issues.
5. Payment Terms
Payment is due immediately upon the completion of service or, if requested by dispatch, prior to the technician's arrival. We accept credit card, debit card, Venmo, Zelle, & cash.
